Terms of Service — PilotBriefAI
1. Acceptance of Terms
By downloading, installing, accessing, or using PilotBriefAI (the "App" or "Service") you agree to these Terms of Service ("Terms") and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App. If you use the App on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. Description of Service
PilotBriefAI aggregates publicly available aviation weather, NOTAM, TFR, PIREP, and winds-aloft data and uses an artificial-intelligence model to produce plain-English preflight situational-awareness summaries, including a non-binding go/no-go indication based on personal minimums you enter. The App can also, at your direction and with your authorization, transmit flight plans to the Federal Aviation Administration through Leidos Flight Service (1800wxbrief.com) and retrieve Flight Service briefing documents and route information. PilotBriefAI's own AI-generated output is intended solely to supplement, and never to replace, official preflight planning tools and adequate preflight information under 14 CFR 91.103.
3. Not a Certified Aviation Source
- PilotBriefAI is not an FAA-approved or FAA-certified weather service, flight-planning product, electronic flight bag, or source of official aeronautical information. Documents retrieved from Leidos Flight Service are produced by Flight Service; PilotBriefAI's own summaries, verdicts, and insights are not official briefings.
- Data (weather, NOTAMs, TFRs, PIREPs, winds aloft, fuel/FBO information, ADS-B positions, route data) is supplied by third parties and government sources, and we do not guarantee that the original sources — including the FAA and Leidos Flight Service — have provided data that is accurate, complete, timely, or properly formatted for display.
- AI-generated summaries, verdicts, and readiness scores can contain errors or omissions and must not be relied upon as fact.
- You must independently verify all safety-critical information from official primary sources before every flight, as required by 14 CFR 91.103 and all other applicable regulations.
- All go/no-go decisions remain solely yours as pilot in command.
4. Flight Plan Filing & Flight Service Integration
- Pilot authorization. Filing and related actions are performed on your behalf under the Service Provider Authorization you grant to PilotBriefAI in your own 1800wxbrief.com account. You may revoke that authorization at any time on the Leidos website. The authority to act flows from your authorization, not from PilotBriefAI.
- National Airspace System. Actions you take through the App's filing features — filing, amending, activating, closing, or cancelling a flight plan, and retrieving briefings — are processed through the FAA's National Airspace System (NAS).
- Transmission is not compliance. PilotBriefAI acts as a transmitter and facilitator. Successful transmission or acceptance of a flight plan does not mean the plan is complete, accurate, or compliant with all applicable requirements. You are solely responsible for reviewing every field before filing and for the regulatory adequacy of any plan filed, amended, activated, closed, or cancelled through the App.
- Flight Service documents. Briefing documents and route data retrieved from Leidos Flight Service are provided to you as received, on an "as-is" basis. Leidos disclaims all warranties regarding its services and materials, and we pass those disclaimers through to you. Unless expressly indicated otherwise in the App, briefing documents retrieved for preview are not recorded to a pilot account with Flight Service.
- Timeliness. Flight plan and briefing transmissions depend on third-party and government systems and may be delayed, rejected, or unavailable. Never depend on the App's availability to meet a filing deadline or regulatory obligation; contact Flight Service directly (1-800-WX-BRIEF) when it matters.
5. Assumption of Risk & Pilot Responsibility
Aviation is inherently dangerous. You acknowledge and agree that you use the Service entirely at your own risk. You are solely responsible for the planning, safe conduct, and outcome of every flight, including compliance with all Federal Aviation Regulations and for confirming that you and the aircraft are legal, current, airworthy, and safe for the intended flight. You expressly assume all risk of property damage, personal injury, or death arising from your use of, or reliance on, the Service, and you agree that PilotBriefAI and its operators bear no responsibility for any such outcome.
6. Eligibility
You must be at least 13 years old to use the App. By using PilotBriefAI you represent that you meet this requirement and that the information you provide is accurate.
7. Account Responsibility
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account, including filing actions taken under your Service Provider Authorization. Notify us immediately through PilotBriefAI → Settings → Support if you suspect unauthorized access.
8. Subscriptions and Payments
- Paid subscriptions are sold and billed through your Apple App Store or Google Play account and managed via RevenueCat. We do not receive or store your payment card details.
- Subscriptions are offered on an auto-renewing basis. Unless cancelled at least 24 hours before the end of the current period, they renew automatically at the then-current price, and your store account is charged for renewal.
- A free trial, where offered, automatically ends after its stated period; continued paid access requires an active subscription.
- Subscription fees are non-refundable except where required by law or by Apple/Google platform policy. Refund requests are handled by the applicable app store.
- You may cancel at any time through your device's subscription settings; cancellation takes effect at the end of the current billing period.
- We reserve the right to change pricing, features, or plan limits with reasonable advance notice.
9. Acceptable Use
You agree not to: reverse-engineer, decompile, or disassemble the App except where that restriction is prohibited by law; access the App or any underlying API in an automated, scraping, or bulk manner not expressly sanctioned by us; resell, sublicense, or use the Service to provide commercial flight-dispatch, certified-briefing, or any other regulated aviation service; file, amend, or cancel flight plans other than for flights you are authorized to conduct, or submit false or misleading information to the FAA or Flight Service through the App; circumvent usage limits, entitlements, or security measures; or use the Service in violation of any applicable law or regulation.
10. Intellectual Property
The App, including its software, design, user interface, text, graphics, logos, trademarks, and the arrangement and presentation of data, is owned by or licensed to PilotBriefAI and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for its intended purpose, subject to these Terms. Underlying aviation weather and NOTAM data are sourced from U.S. government public-domain datasets and other third-party providers. Leidos and 1800wxbrief names are the property of their respective owners and are used solely to factually identify the Flight Service system the App connects to. All rights not expressly granted are reserved.
11. Third-Party Services & Data
The Service relies on third-party providers and data sources, including the FAA, Leidos Flight Service (1800wxbrief.com), NOAA / aviationweather.gov, ADS-B networks, LiveATC.net, Windy, Anthropic (Claude), Supabase, and RevenueCat. We do not control these services, do not guarantee their accuracy, availability, or timeliness, and are not responsible for any interruption, error, delay, outage, or loss arising from them. Your use of third-party content may be subject to the respective provider's terms, including Leidos's own terms and disclaimers applicable to Flight Service.
12. Service Availability
The Service is provided on an "as available" basis. We do not warrant that it will be uninterrupted, timely, secure, or error-free, and we may modify, suspend, or discontinue any part of it at any time without liability. You must never depend on the App's availability for any flight-critical purpose.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, COMPLETENESS, TIMELINESS, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE, ITS DATA, ANY AI OUTPUT, OR ANY FLIGHT PLAN OR BRIEFING TRANSMISSION IS ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR ANY AVIATION DECISION.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PILOTBRIEFAI AND ITS OWNERS, OPERATORS, OFFICERS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR ANY PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH, ARISING FROM OR RELATING TO YOUR USE OF OR RELIANCE ON THE SERVICE — INCLUDING ANY FLIGHT PLAN FILED, AMENDED, ACTIVATED, CLOSED, CANCELLED, OR NOT TRANSMITTED, AND ANY BRIEFING DOCUMENT RETRIEVED OR NOT RETRIEVED — WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN OF THESE LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
15. Indemnification
You agree to indemnify, defend, and hold harmless PilotBriefAI and its owners, operators, officers, employees, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any law or regulation (including the Federal Aviation Regulations), any flight plan or information you submit to the FAA or Flight Service through the App, or any flight conducted by or for you.
16. Dispute Resolution & Class-Action Waiver
Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration administered in the State of Texas under the rules of a recognized arbitration provider, rather than in court, except that either party may bring an individual claim in small-claims court. You and PilotBriefAI agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class or representative proceeding. If this waiver is found unenforceable, the remainder of this section shall not apply. Where binding arbitration is not permitted by law, this section does not limit your statutory rights.
17. Termination
We may suspend or terminate your access to the Service at any time for any violation of these Terms or for any conduct we reasonably believe is unlawful or harmful. Sections that by their nature should survive termination — including Intellectual Property, Assumption of Risk, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Dispute Resolution — survive.
18. Changes to Terms
We may update these Terms at any time. Material changes will be communicated in-app or by email. Continued use after the effective date constitutes acceptance of the revised Terms.
19. Severability & Entire Agreement
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and PilotBriefAI regarding the Service and supersede any prior agreements. Our failure to enforce any right is not a waiver of it.
20. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
